1. Acceptance of Terms

By installing, launching, or using Map Expand (the "Software"), you ("User") agree to be bound by this End User License Agreement ("Agreement"). If you do not agree to all terms of this Agreement, do not use the Software.

2. License Grant

Subject to the terms of this Agreement, W. Fantasy Studio Ltd. ("Licensor") grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software for personal and commercial purposes, provided that such commercial use is consistent with the terms of service of the AI provider you use (e.g., Google Gemini API) and does not infringe any rights applicable to your source material.

3. Ownership of Generated Content

You retain all rights, title, and interest in any maps, images, or other content you generate using the Software ("Generated Content"), to the extent permitted by applicable law and the terms of the AI service provider you use (e.g., Google Gemini API terms of service).

The Licensor claims no ownership over your Generated Content. However, by using the Software you acknowledge that the final copyright status of AI-generated works may be subject to evolving legislation and is your sole responsibility to verify.

4. User Responsibility for Source Material

You are solely responsible for ensuring that any map, image, or other content you upload into, or process with, the Software is either:

Your own original work that you own all rights to; or
Licensed to you in a way that permits the intended use, including AI processing.

Do not use the Software to process copyrighted material without the explicit permission of the rights holder. The Licensor accepts no liability for any infringement resulting from your use of unlicensed source material.

5. Third-Party API Costs — Bring Your Own Key (BYOK)

Map Expand uses the Google Gemini API (via Google AI Studio or Vertex AI) to generate images. You supply your own API key. All API calls are made directly from your device to Google's servers using your credentials.

By using the Software, you acknowledge and agree that:

You are solely responsible for all costs, fees, and charges billed by Google or any other third-party provider to your account as a result of your use of the Software.
The Licensor has no visibility into your API usage, your billing account, or the amounts charged to you by any third party.
The Licensor will not reimburse, compensate, or otherwise be liable for any third-party API costs you incur, regardless of the cause, including but not limited to software bugs, unexpected retries, failed generations, or usage spikes caused by the Software.

You are advised to monitor your Google Cloud / AI Studio billing console regularly and to treat any in-app figures as estimates only.

Activity Log

The in-app Activity Log records generation events locally on your device as a convenience reference. It is intended to help you correlate generation events with API charges. It does not guarantee the accuracy or completeness of billing information and is provided "as-is" with no warranty of correctness.

Spending Stats

The Spending Stats feature aggregates local event data to produce approximate cost estimates only. These figures are calculated locally and may differ from the amounts actually billed by Google or any other provider. They are not official billing data.

For accurate, authoritative usage and billing information you must consult your Google AI Studio or Google Cloud billing dashboard directly. The Licensor accepts no liability for any discrepancy between in-app estimates and amounts actually charged to your account.

6. Alpha Software Disclaimer

The Software is provided in an Alpha (pre-release) state. Alpha software may contain significant bugs, incomplete features, or stability issues. The Licensor makes no representations or warranties regarding the suitability of the Software for any purpose.

Specifically, but without limitation:

Generations may fail, produce unexpected results, or consume API quota without delivering output.
Data (projects, tiles, snapshots) may be corrupted or lost due to software bugs.
The Software may crash, hang, or behave incorrectly on your system.
Features, interfaces, and file formats may change between versions without backward compatibility.

7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, OR BE ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, COSTS OF SUBSTITUTE GOODS OR SERVICES, OR ANY OTHER INTANGIBLE LOSS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE LICENSOR'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SOFTWARE EXCEED ZERO EUROS (€0.00). THE LICENSOR ACCEPTS NO FINANCIAL LIABILITY OF ANY AMOUNT WHATSOEVER.

Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages; in such jurisdictions, the Licensor's liability is limited to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Licensor and its affiliates, officers, and employees from any claim, demand, loss, liability, and expense (including reasonable legal fees) arising out of: (a) your use of the Software; (b) your Generated Content; (c) your violation of this Agreement; or (d) your infringement of any third-party intellectual property rights.

10. Prohibited Uses

You may not use the Software to:

Process any material that infringes third-party intellectual property rights.
Generate, store, or distribute illegal, abusive, or harmful content.
Circumvent, reverse-engineer, or tamper with the Software for unlawful purposes.
Violate any applicable local, national, or international law or regulation.

11. Changes to This Agreement

The Licensor reserves the right to update this Agreement at any time. Continued use of the Software after an updated Agreement is published constitutes your acceptance of the revised terms.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict-of-law provisions, unless otherwise required by mandatory local consumer protection law in your jurisdiction.
